2023 SYNERGY® LIVING IN GRATITUDE PROMOTION (“Promotion”)
Terms & Conditions

PROMOTION PERIOD: Promotion begins at 12:00 a.m. Pacific Time (“PT”) on October 18, 2023, and ends at 11:59 p.m. PT on November 30, 2023, or while supplies last, whichever is sooner (“Promotion Period”). During the Promotion Period, Sponsor will post a call to action (1 static in-feed post) to participate in the Promotion (the “CTA Post”) from the @SynergyKombucha Instagram account. As soon as an applicable CTA Post is issued, eligible participants may participate in the Promotion as provided herein.

ELIGIBILITY: To be eligible to participate, you must be a legal resident of one of the 50 United States or D.C. and be 18 years of age or older (19 in AL or NE) (each, a “Participant(s)”). Participants also need to have a personal Instagram account. If you do not have an Instagram account, you may create a free account at https://www.instagram.com. Employees, officers, directors and agents of GT Living Foods (“Sponsor”) their respective bottlers, subsidiaries, affiliated companies, and divisions, any other company involved in the presentation, administration or fulfillment of this Promotion (collectively, the “Promotion Entities”) and each of their respective immediate family members (defined as including spouse, biological, adoptive and step-parents, grandparents, siblings, children and grandchildren, and each of their respective spouses, regardless of where they reside) and/or those living in the same household members (whether or not related) are not eligible to receive a coupon in the Promotion. Void outside the eligibility area and where prohibited or restricted by law.

PROMOTION OFFER: The first 2,500 participants that complete a valid submittal, as described in paragraph below, or all of the participants that complete a valid submittal by 11/30/23, if less than 2,500 (whichever occurs first), will receive one (1) Coupon for a Free 10oz-16oz SYNERGY and one (1) Coupon for a Free 10oz-16oz SYNERGY will be sent to the person that they tagged in their submittal. Coupons are good for all flavors; up to a $4.99 value; expiration date is 12/31/24).

HOW TO COMPLETE A SUBMITAL AND RECEIVE A COUPON: After the CTA Post is made on the Instagram Account as listed in “Promotion Period”, you may participate by commenting on the applicable CTA Post. Comment must include: (a) @tagging the handle of someone for which you are grateful (they must be eligible based on the Eligibility section above) and (b) explaining why you are grateful for them (a “submittal”).

Limit one (1) Comment per Instagram Account during the Promotion Period.

Once you have complied with all the submittal requirements set forth above, you will receive a notification via Instagram direct message from the @SynergyKombucha account within 1-2 weeks. The message will include a link to an external website (‘the “Website”) where you will be required provide your complete home mailing address within the timeframe specified. Once your upload has been verified for eligibility and compliance with these Terms & Conditions, you will receive your coupon via USPS within 4-6 weeks.

Participation constitutes participant’s full and unconditional agreement to these Terms & Conditions and Sponsor’s decisions and interpretations, which are final and binding in all matters related to the Promotion. Submittals that appear to duplicate any other submittals, in Sponsor’s sole discretion, will be void and only the first submittal (based on time/date) will be considered for the Promotion. Submittals generated by script, macro or other automated means or in violation of these Terms & Conditions will be void. In the event of a dispute as to the identity of a person, participant will be deemed the individual named on the account from which the comment was submitted, and such individual must meet all eligibility requirements set forth herein and otherwise comply with these Terms & Conditions. In the event of non-compliance with any requirements specified herein, submittal will be void. Your submittal constitutes your representation of eligibility, consent to participate in Promotion and consent for Sponsor to obtain, use, and transfer your name, address, and other information for the purpose of promotion administration.

NOTE ABOUT MOBILE DATA CHARGES: When you participate in the Promotion via a mobile device, standard data rates may apply according to the terms and conditions of your service agreement with your wireless carrier. Other charges may apply (such as normal airtime and carrier charges) and may appear on your mobile phone bill or be deducted from your prepaid account balance. Wireless carriers’ rate plans may vary, and you should contact your wireless carrier for more information on rate plans and charges relating to your participation in this Sweepstakes. Check your mobile device’s capabilities for specific instructions. A mobile device is not required to enter.

LIMITATIONS OF LIABILITY AND RELEASE: No liability or responsibility is assumed by Sponsor, the Promotion Parties, or any of their respective subsidiaries, affiliates, officers, directors, employees, governors, owners, distributors, retailers, agents, assignees, advertising agencies, representatives, and agents (“Released Parties”) resulting from participation in or attempt to participate in the Promotion or inability to upload or download any information in connection with the Promotion. No responsibility or liability is assumed by Sponsor or Promotion Parties for technical problems or technical malfunction arising in connection with any of the following occurrences which may affect the operation of the Promotion: Hardware or software errors; faulty computer, telephone, cable, satellite, network, electronic, wireless or Internet connectivity or other online or network communication problems; errors or limitations of any Internet or wireless service providers, servers, hosts or other providers; garbled, jumbled or faulty data transmissions; failure of any online transmissions to be sent or received; lost, late, delayed or intercepted transmissions; inaccessibility of the Website in whole or in part for any reason; traffic congestion on the Internet or the Website; unauthorized human or non-human intervention of the operation of the Promotion, including without limitation, unauthorized tampering, hacking, theft, virus, bugs, or worms; or destruction of any aspect of the Promotion or loss, miscount, misdirection, inaccessibility or unavailability of an Instagram account used in connection with the Promotion. Released Parties are not responsible for any printing, typographical, technical, computer, network or human error which may occur in the administration of the Promotion or these Terms & Conditions or in any Promotion-related materials. Use of Website is at user’s own risk. Sponsor and Promotion Parties are not responsible for any personal injury or property damage or losses of any kind which may be sustained to user’s or any other person’s computer or Web-enabled device resulting from participation in the Promotion.

RELEASE OF LIABILITY: By participating in the Promotion and accepting a SYNERGY Coupon, participants agree (a) to release Sponsor, the Released Parties from any and all claims, damages or liabilities arising from or relating to such participation in the Promotion; (b) under no circumstances will participant be permitted to obtain awards for, and participant hereby waives all rights to claim, punitive, incidental, consequential, or any other damages, other than for actual out-of-pocket expenses; (c) all causes of action arising out of or connected with this Promotion, shall be resolved individually, without resort to any form of class action; and (d) any and all claims, judgments, and award shall be limited to actual out-of-pocket costs incurred, excluding attorneys’ fees and court costs. By accepting a SYNERGY Coupon, recipients agree that the Released Parties will have no liability whatsoever for, and shall be held harmless by participant against, any liability for injuries, losses, or damages of any kind to persons or property resulting in whole or in part, directly or indirectly, from participation in the Promotion or from acceptance, possession, or use of the Coupon.

GENERAL: All information submitted online by participant is subject to, and will be treated in a manner consistent with, Sponsor’s Terms of Use and Privacy Policy accessible at: https://gtslivingfoods.com/pages/privacy-policy. By participating, you agree (i) to be bound by these terms and conditions and the decisions of Sponsor which are final and binding, and (ii) to release and hold harmless Sponsor, their respective parent companies, affiliates, subsidiaries, divisions and/or advertising or promotion agencies, individuals or entities responsible for the development, printing, distribution and implementation of this Promotion, against any liability, for any injuries, losses or damages of any kind, including death, to persons, or property resulting in whole or in part, directly or indirectly, from participation in this Promotion. Promotion is subject to all applicable federal, state, and local laws.
CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEBSITE ASSOCIATED WITH THIS PROMOTION OR UNDERMINE THE CONTENT OR LEGITIMATE OPERATION OF THIS PROMOION MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, GT’S LIVING FOODS WILL DISQUALIFY ANY PARTICIPANT RESPONSIBLE FOR THE ATTEMPT, AND GT’S LIVING FOODS AND IT’S RESPECTIVE AGENTS RESERVE THE RIGHT TO SEEK DAMAGES (INCLUDING ATTORNEYS’ FEES) AND OTHER REMEDIES FROM ANY PERSON OR PERSONS RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW.

Should any portion of the Promotion be, in Sponsor’s sole opinion, compromised by bugs, virus, worms, non-authorized human intervention or other causes, which, in the sole opinion of Sponsor, corrupt or impair the administration, security, fairness or submission of information, Sponsor reserves the right at its sole discretion to cancel, suspend or terminate the Promotion.
